Terms of Service

These Terms of Service ("Terms") constitute a binding legal agreement between you ("User", "you") and Safarix Cab Private Limited ("Safarix", "we", "us", "our"), a company incorporated under the Companies Act, 2013 with its registered office at P. No. 40, Paldi Meena, Agra Road, Jaipur 302031. These Terms govern your access to and use of the Safarix mobile application, website at safarix.in, and related services (collectively, the "Platform").

1. Acceptance of terms

By creating an account, listing a trip, booking a seat, or otherwise using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, the Privacy Policy, the Refund Policy, and any additional policies referenced herein. If you do not agree, you must not use the Platform.

2. Nature of service

Safarix is a technology platform that connects drivers who are planning private journeys ("Drivers") with riders who wish to share those journeys ("Riders"). Safarix is not a transport service provider, taxi operator, or carrier. We do not own, operate, lease, or control any vehicles, nor do we employ Drivers. The contractual relationship for each trip is between the Driver and the Rider directly.

Safarix's role is limited to providing the technology that enables matching, communication, and payment between Users. Any reference to "shared trip", "carpool", or similar term in our communications shall be construed accordingly.

3. Eligibility

You may use the Platform only if you:

• Are at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872;
• Are not barred from using the Platform under applicable law;
• For Drivers: hold a valid Indian driving license, valid vehicle registration certificate (RC), valid insurance covering the vehicle for the purpose of the trip, and a valid pollution-under-control (PUC) certificate where applicable.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. Safarix may suspend or terminate accounts that contain false, misleading, or fraudulent information.

5. Driver obligations

If you list a trip as a Driver, you represent and warrant that:

• You hold all licenses, permits, and registrations required to legally operate the vehicle for the trip;
• The vehicle is roadworthy, properly insured, and used in compliance with the Motor Vehicles Act, 1988 and rules made thereunder;
• You will not operate the vehicle under the influence of alcohol, drugs, or any other intoxicant;
• The price per seat charged is intended to cover trip costs (such as fuel and tolls) and does not constitute a commercial fare;
• You will treat Riders with respect and follow all applicable traffic and safety regulations.

6. Rider obligations

If you book a seat as a Rider, you agree to:

• Arrive at the agreed pick-up point on time;
• Behave courteously, respect the Driver's vehicle, and follow reasonable safety instructions;
• Not carry illegal goods, hazardous materials, or anything that may endanger the Driver, vehicle, or other Riders;
• Pay the agreed price per seat through the Platform's payment flow.

7. Payments & fees

Payments for trips are processed through third-party payment gateways. Safarix may charge a platform convenience fee, which will be disclosed before payment is confirmed. Drivers receive their share of the trip payment, less any applicable platform fees and statutory deductions, within the timelines published in the Platform.

You acknowledge that payment processors may impose their own terms and fees, and Safarix shall not be liable for any failure attributable to the payment processor.

8. Cancellation

Cancellation and refund eligibility are governed by our Refund Policy. Repeated or last-minute cancellations may result in temporary or permanent restrictions on your account.

9. Prohibited conduct

You agree that you will not, and will not permit any third party to:

• Use the Platform to commit fraud, harassment, discrimination, or any unlawful activity;
• Use the Platform to operate a commercial taxi or transport business without appropriate licenses;
• Circumvent the Platform's payment flow by collecting cash or off-platform payments after a confirmed booking;
• Upload viruses, malware, or any code that interferes with the Platform's functioning;
• Scrape, reverse engineer, or reuse the Platform's data without our prior written consent;
• Impersonate any person, misrepresent your affiliation, or upload another person's identity or vehicle documents.

10. Intellectual property

All content on the Platform — including the "Safarix" name, logo, mobile apps, website, software, designs, text, graphics, and the underlying source code — is owned by or licensed to Safarix Cab Private Limited and is protected by Indian and international copyright, trademark, and other intellectual-property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. No other rights are granted by implication, estoppel, or otherwise.

11. Limitation of liability

The Platform is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Safarix and its officers, directors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill;
• Any conduct or omission of any Driver or Rider, or any incident occurring during or in connection with a trip;
• Any failure or delay in performance caused by events beyond our reasonable control (force majeure).

Safarix's aggregate liability in respect of all claims arising out of or relating to your use of the Platform shall not exceed the platform fees actually paid by you to Safarix in the six (6) months preceding the event giving rise to the claim.

12. Indemnity

You agree to indemnify, defend, and hold harmless Safarix and its affiliates from and against any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any applicable law, or (c) your infringement of any third-party right.

13. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms, applicable law, or the safety or integrity of the Platform. You may terminate your account at any time by writing to support@safarix.in. Provisions that by their nature should survive termination shall do so.

14. Governing law & jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the dispute-resolution mechanism set out below, the courts at Jaipur shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms.

Any dispute, controversy, or claim shall first be referred to good-faith negotiation between the parties. If not resolved within thirty (30) days, the dispute shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Jaipur, and the language shall be English.
